the mastermind should get the maximum penalty. This life was not so beautiful that 'it' conspired to end the life of another human.
I agree with the state's decision. Whether others involved got the DP or not is a separate issue. Did this person get the punishment he deserved? I think so.

McALESTER, Okla. – A man convicted of battering his girlfriend's 8-year-old son and stuffing the dead body in a freezer has been put to death in Oklahoma.

Oklahoma Department of Corrections spokesman Jerry Massie says 48-year-old Donald Gilson was pronounced dead at 6:19 p.m..

Gilson was convicted of first-degree murder in 1998 for the death of 8-year-old Shane Coffman. The boy's remains were found in an abandoned freezer outside a mobile home in rural Cleveland County.

An autopsy showed two fractures to the boy's skull, a tooth missing from his right jaw and fractures to his collarbone, shoulder blades, ribs, legs and spine.

Gilson became the second person to be executed this year in Oklahoma.

ATMORE, Ala. – An Alabama inmate has been executed for the 1990 killing of a mother of six, his death witnessed by all of the victim's grown children from a room steps away.

Willie McNair, 44, was pronounced dead at 6:17 p.m. Thursday after a lethal injection at Holman Prison. He was condemned for the stabbing death of Ella Foy Riley, a 68-year-old retired textile worker.

Alabama's governor signed a law recently to allow six witness from the victim's side and six from the inmate's side to witness state executions. Previously it was two from each side.

Riley's six children said afterward they waited 19 years for justice. Each wore a button bearing a photograph of their mother and the words: "You are not forgotten."

No relatives for McNair witnessed his execution.

New Mexico justice system can't keep up with the Astorga brothers, but Kansas mud can.
The brother of accused cop killer Michael Paul Astorga was charged this week in connection with a fatal shooting of a 50-year-old man in Kansas.

The Astorga brothers - Michael, Matthew and Anthony Lucero - have now been accused or convicted of killing five people, including a Bernalillo County sheriff's deputy, a soldier and a lifelong friend. Their records are quite lengthy and include a long history of eluding and working the criminal justice system.

Consider:

Michael Paul Astorga led police on one of the largest manhunts in New Mexico history in March 2006 after he allegedly killed James McGrane Jr. He was eventually found in Juarez. At the time, he was also on the lam for a 2005 killing of Candido Martinez. After allegedly killing Martinez, Michael Astorga walked into his probation officer's office to check in. The probation officer failed to run a warrant check on Astorga, which would have shown he was wanted for killing Martinez. Astorga was let go. Police say that Astorga's family helped him elude authorities during the manhunt. His wife was charged federally.

Matthew Astorga served six years in prison for killing 27-year-old Jose Maldonado Sigala, who was shot five times with a shotgun outside his Martineztown home. Initially, Matthew Astorga was sentenced to 16 years in prison, but in 1999 the state Court of Appeals ruled that he should receive a new trial. The jury should have had the opportunity to convict him of voluntary manslaughter, a lesser crime, the court said. He then pleaded guilty to second-degree murder and was sentenced to eight years. In April 2001, after serving about five years in prison and getting credit for good time, Matthew Astorga was released on parole. More than three years later, in October 2004, he violated the conditions of his parole because he didn’t check in with his parole officer. He was sentenced to three more years, according to court records. After getting credit for good time again, was released, thus serving about six and a half years in connection with Sigala’s killing.

Anthony Lucero was on the loose for several months after he killed his estranged wife's boyfriend. An Army court-martial at Fort Hood, Texas, convicted Lucero, who was a soldier, of murder. He is serving a life sentence without the possibility of parole at Fort Leavenworth military prison in Kansas. Authorities say Lucero, an Army private, killed Oly Felipe, 22, who was also a soldier, in 2001. At the time, Lucero and his wife were expected to get a divorce. Both men were on leave from Fort Hood, Texas. Lucero, who was 25 at the itme, shot Felipe in the head outside a Taylor Ranch home, according to court records. The shooting took place after Lucero went to the home of his in-laws to drop off his daughter and saw Felipe. Lucero opened his shirt, showed a gun, shot Felipe in the head and laughed after killing him, court records state. Before the shooting, Lucero dropped a bullet in his wife’s lap. The shooting occurred in front of two young children, including Lucero’s. It took authorities several months to find Lucero, in part because his family helped him elude capture, prosecutors said. Lucero was arrested during a traffic stop. He was also wanted on a military desertion charge.

But, you can't escape those Kansas law dogs. After Friday's shooting in Leavenworth, police there say Matthew Astorga tried to get away. One officer who was responding to the shooting spotted a pickup speeding in the opposite direction. The officer turned around and tried to pull the truck over, but the driver wouldn’t stop.
Eventually the truck got stuck in mud and police took into custody the driver, who they say was Matthew Astorga. They found a .40 caliber handgun in the truck.

Matthew Astorga is now in Custody in Leavenworth on a $1 million bond.

Bernalillo County Sheriff Darren White described the history of the Astorgas as embarrassing when he was interviewed Tuesday night about the recent arrest of Matthew Astorga in Kansas.

"Matthew Astorga is yet another example of the turn-syle justice system that has miserbly failed New Mexico and, regrettably, now Kansas," he said. "It is embarrassing."

DA will pursue death penalty against Astorga

File: Michael AstorgaAn accused deputy killer's attorney says the DA should drop the death penalty charge against his client because of the recent death penalty repeal, even though the law doesn't go into effect until July 1.
Ever since Michael Astorga was arrested and charged with killing Deputy James McGrane, his trial has not even come close to beginning.

McGrane was shot and killed during a traffic stop in Tijeras three years ago.

Astorga was captured in Mexico two weeks later and has been sitting in prison ever since.

His attorney, Gary Mitchell, took his case to the state Supreme Court, arguing that a jury cannot deliberate fairly when it comes to a death sentence.

Astorga's case can't move on until the Supreme Court makes a decision. And that’s not expected for at least a couple of months.

Mitchell says Astorga's case, and others involving the death penalty, could move along if Bernalillo County District Attorney Kari Brandenburg tries for life sentences instead.

"I would expect her to know that the end result is those men will not face the death penalty and that we should go ahead and decide accordingly now so we can move ahead with the cases," Astorga’s attorney said.

Mitchell says since Governor Richardson repealed the state's death penalty, it's even less likely that Astorga would ever actually be put to death if he's found guilty.

Brandenburg says she knows that already, but she also says there's good reason to continue pursuing a death penalty for Astorga.

"What a life sentence in New Mexico up to this point is 30 years, basically for first degree homicide, so if he isn't given the death penalty, then he's looking at a 30-year sentence and the possibility that he will walk the streets again," Brandenburg said.

If Astorga is convicted and gets a life sentence, he'd only be eligible for parole after 30 years. It doesn't mean he would get out.

Astorga is not eligible for life without parole because the new law doesn't apply to him.

OKLAHOMA CITY -- Governor Brad Henry denied clemency Monday to death row inmate Donald L. Gilson, clearing the way for the convicted killer's scheduled execution on May 14 at the State Penitentiary in McAlester.

In a 3-2 vote last month, the State Pardon and Parole Board recommended that Gilson be granted clemency and his sentence be reduced to life in prison without parole.

Since then, Governor Henry has reviewed all documents and information related to the recommendation in addition to interviewing prosecution and defense attorneys involved in the case.

"I take all clemency recommendations very seriously and I gave this matter the thorough deliberation it deserved," said Governor Henry. "At the end of my review, I decided that this case did not merit clemency and a commutation of the jury's sentence."

During Governor Henry's term in office, the State Pardon and Parole Board has recommended clemency for six death row inmates. The governor has approved only two such recommendations, commuting the sentences to life in prison without parole.

Gov. Brad Henry has postponed an execution while he considers a state board's recommendation that the sentence for a man convicted in the beating death of a boy be reduced to life in prison without parole.

Donald Gilson was scheduled to die May 5. Henry granted a brief stay Thursday to give him more time to review the recommendation and rescheduled the execution for May 14.

Gilson was convicted of first-degree murder in the death of 8-year-old Shane Coffman, whose body was found in a freezer behind Gilson's trailer in Newalla on Feb. 9, 1996. Investigators believe the boy died sometime around Aug. 17, 1995.

A medical examiner's report revealed Coffman suffered acute fractures to his left jaw and right cheek in addition to a cracked upper incisor and fractures of the left collarbone, several ribs, a shoulder, a leg and his spine.

Gilson's attorney said testimony indicated Gilson did not abuse the boy on the day of the child's death and was instead convicted for permitting child abuse. The boy's mother, Bertha Jean Coffman, was sentenced to life without parole in the case.

The Oklahoma Pardon and Parole Board has recommended clemency for five death row inmates since Henry took office in 2003. He has approved two of those recommendations.

Willie McNair knew Ella Foy Riley. Over the years, he had done yard work and other tasks for her, and she and her husband had given small gifts and work to other members of his family.

On Thursday, McNair is to be executed for the robbery/murder of Riley in her southeast Alabama home on May 21, 1990. Riley was a mother of six who spent years stitching bedsheet seams at an Abbeville textile plant. Her daughter, Pat Jones, found her lying on her kitchen floor.

Pat Jones and her youngest brother, Wayne, the only Riley siblings who now live in Abbeville, had planned to witness McNair's death by lethal injection at Holman Correctional Facility near Atmore. But now that a bill passed by the Alabama Legislature to allow up to six members of a murder victim's immediate family to witness an execution is expected to become law, the four other Riley brothers are likely to join them in the witness room.

"You know, we didn't choose to be where we are," said Jones, who heads the southeast Alabama chapter of VOCAL (Victims of Crime and Leniency). "We didn't choose to go to those trials. We didn't choose for Mother to be murdered. But we had to be there, so being there for this is kinda like putting the last piece of the puzzle together."

For the witness bill to become law, Gov. Bob Riley must sign it. In a Friday e-mail, Jeff Emerson, a spokesman for the governor, said the witness bill "hasn't been transmitted to our office yet."

On Friday, attorneys with the Equal Justice Initiative asked the Alabama Supreme Court to postpone McNair's execution and order a review of his sentence. In their petition, the attorneys said the trial judge overrode the jury's recommendation of life imprisonment without parole for McNair and sentenced him to death without giving the jury's decision the consideration it deserved.

The petition also states the jury had received evidence that McNair had used cocaine on the day of the crime, that he had had "a good upbringing and lack of problems" before becoming addicted to the drug, but his attorneys failed to present expert testimony on the effects of cocaine use. There also was evidence that raised questions as to whether McNair had "delivered the killing blow" to Riley, the petition states.

McNair's mother said her son, the oldest of her six children who has the family nickname of "Chubby," has told her he is ready for whatever happens.

"He said he's talked to the Lord about it, and he told the Lord he wants to make peace with him and ask him for forgiveness," Annie Glanton said. "He said, `Whatever they do to the body, they ain't doing it to the soul because the soul belongs to God. It's going to be all right 'cause God wasn't intending for me to be locked up all my life. It's better to be present with God and be absent from the body.'"

During the course of the meal, Brian's mother couldn't help but keep
noticing how beautiful Brian's roommate, Stephanie, was.

Brian's Mom had long been suspicious of a relationship between Brian and

Over the course of the evening, while watching the two react, she started to wonder if there was more between Brian and Stephanie than met the eye.

It was my first day as newcomer to Miss Hargrove¡¯s seventh grade. Past ¡°newcomer¡± experiences had been difficult, so I was very anxious to fit in. After being introduced to the class, I bravely put on a smile and took my seat, expecting to be shunned.

Lunchtime was a pleasant surprise when the girls all crowded around my table. Their chatter was friendly, so I began to relax.wow power leveling My new classmates filled me in on the school, the teachers and the other kids. It wasn¡¯t long before the class nerd was pointed out to me: Mary Lou English. Actually she called herself Mary Louise. A prim, prissy young girl with a stern visage and old-fashioned clothes, she wasn¡¯t ugly -- not even funny looking. I thought she was quite pretty,wow gold but I had sense enough not to say so. Dark-eyed and olive-skinned, she had long, silky black hair, but -- she had pipe curls! Practical shoes, long wool skirt and a starched, frilly blouse completed the image of a complete dork. The girls¡¯ whispers and giggles got louder and louder. Mary Lou made eye contact with no one as she strode past our table, chin held high with iron determination. She ate alone.

After school, the girls invited me to join them in front of the school.wow power leveling I was thrilled to be a member of the club, however tentative. We waited. For what, I didn¡¯t yet know. Oh, how I wish I had gone home, but I had a lesson to learn.

Arms wrapped around her backpack, Mary Lou came down the school steps. The taunting began - rude, biting comments and jeering from the girls. I paused, then joined right in. My momentum began to pick up as I approached her. Nasty, mean remarks fell unabated from my lips. No one could tell I¡¯d never done this before. The other girls stepped back and became my cheerleaders. Emboldened, I yanked the strap of her backpack and then pushed her. The strap broke, Mary Lou fell and I backed off. Everyone was laughing and patting me. I fit in. I was a leader.

I was not proud. Something inside me hurt.wow power leveling If you¡¯ve ever picked a wing off a butterfly, you know how I felt.

Mary Lou got up, gathered her books and -- without a tear shed or retort given -- off she went. She held her head high as a small trickle of blood ran down from her bruised knee. I watched her limp away down the street.

I turned to leave with my laughing friends and noticed a man standing beside his car. His olive skin, dark hair and handsome features told me this was her father.wow gold Respectful of Mary Lou¡¯s proud spirit, he remained still and watched the lonely girl walk toward him. Only his eyes -- shining with both grief and pride -- followed. As I passed, he looked at me in silence with burning tears that spoke to my shame and scalded my heart. He didn¡¯t speak a word.

I know how hard it is to trust the legal system either way. In Britain you get a slap on the wrist for murder and banged up for years for fraud. It ought to be the other way round.

I am a reluctant pro. I don't like the idea of executing anyone but sometimes there just are some crimes that really don't seem appropriate unless the murderer is executed.

It's not going to happen in Britain of course unless we get the sort of government that I wouldn't like at all like the BNP or other extremist groups.

Confront a yob on the top deck of a bus, or a bunch of louts loitering outside your front door, and you risk being stabbed, shot or kicked to death. With the increase in drugs, guns and lawlessness, Britain is awash with criminals who do not hesitate to casually and cruelly end a life.
In England, the House of Commons concluded that capital punishment must be seen as inhuman and degrading and abolished capital punishment in 1973. The death penalty is now prohibited by Protocol 13 of the European Convention on Human Rights. Also Article 7 of the EU treaty states that action will be taken against member states where there is a 'clear risk of a human rights breach'. However, we citizens also have rights and the death penalty should have a place in our protection as a last resort and reminder that there are crimes so heinous that only the ultimate penalty is sufficient todays news need i say more !!!!

Homeless man executed for killing helpful woman

Proclaiming his innocence, condemned prisoner Gregory Wright was executed Thursday evening for the fatal stabbing and robbery of a Dallas-area woman who tried to help him when he was homeless.

"There's been a lot of confusion who done this," Wright said from the death chamber gurney.

Then, as he has for years, he declared a fellow homeless man, John Adams, was responsible for the murder of Donna Vick.

"I never sold anything to anyone. My only act or involvement was not telling on him. John Adams was the one that killed Donna Vick. The evidence proves that. ... I was in the bathroom when he attacked. I ran into the bedroom. By the time I came in, when I tried to help her with first aid it was too late."

He said an innocent man was being put to death and said he loved his family. "I'll be waiting on y'all. I am finished talking."

9 minutes after the lethal drugs began to flow, he was pronounced dead at 6:20 p.m. CDT.

Wright, 42, was 1 of 2 homeless men convicted of killing Donna Duncan Vick, 52, at her home in DeSoto, just south of Dallas, in 1997. The woman was known for helping the needy and had given Wright food, clothing and money after he said she spotted him on a street corner holding a cardboard sign offering to work for food.

Wright, an out of work truck driver, maintained he was innocent of the killing and blamed it on a fellow homeless man, John Adams. Adams was tried separately and also was convicted and sentenced to death.

The U.S. Supreme Court rejected an appeal by Wright less than an hour before he was scheduled to be taken to the Texas death chamber. Other federal courts had rejected similar appeals and the Texas Board of Pardons and Paroles also refused a clemency request for Wright on a 7-0 vote Wednesday.

"The truth doesn't matter," Wright told The Associated Press recently from a visiting cage outside death row, saying he was stunned at the outcome of his 1998 trial in Dallas. "I couldn't believe what was happening. I'm very upset at a number of different people. I don't blame the legal system. I blame individuals running the legal system. ... I am innocent."

Adams, who implicated Wright as the killer, earlier this year recanted his statement against Wright. Then at a court hearing last month, he reversed his recantation.

"The co-defendant has been a bit erratic," Meg Penrose, one of Wright's lawyers, said Thursday.

She said she understood demands for an execution in the case "but I thought justice demanded we executed the right person."

"I guess there's a difference of emphasis," Penrose said. "I'd rather wait 30 years and make sure we have the proper individual executed than wait 12 and hedge our bets. I don't like the rush to review that we're at. A person who is innocent is rushed to the gurney and is executed."

New DNA tests requested by Wright's lawyers, which put off Wright's execution initially scheduled for last month, "on the whole, confirmed Wright's guilt," state attorneys told the appeals courts in their arguments. Penrose contended the tests were ambiguous.

At Wright's trial, jurors were told that after the killing, the 2 men packed up items from inside the house, drove off in Vick's car and traded the loot for crack cocaine.

A day and a half later, Adams turned himself in to police, implicated Wright, directed officers to Vick's home and helped in the recovery of her car. DNA tests of blood on the steering wheel of the car was shown to belong to Wright. His bloody fingerprint also was found on a pillowcase on her bed. Wright's lawyers disputed the accuracy of the fingerprint evidence.

From death row, Wright refused to talk about specifics of the crime, saying only that it stemmed from an argument between Vick and Adams over Adams' smoking.

"This should have been finished long ago because there's no question about his guilt and there should be no question about the jury's verdict either," said Greg Davis, who prosecuted Wright. "He and Adams had been living on the streets together. So what he does, he talks his way into the victim's home and then he gets Adams in there, too. Both them actually stabbed her to death."

Wright becomes the 14th condemned inmate to be put to death this year in Texas, the 2nd this week and the 419th overall since the state resumed capital punishment on Dec. 7, 1982. Wright becomes the 180th condemned inmate to be put to death in Texas since Rick Perry became governor in 2001.

6 more men are set to die in November; scheduled to die next is Elkie Taylor, 47, on Nov. 6. Taylor was condemned for strangling a 65-year-old Fort Worth man in 1993 with 2 wire coat hangers and then leading police on a four-hour chase in a stolen 18-wheeler. Authorities said the robbery and murder of Otis Flake at Flake's Fort Worth home was the second killing linked to Taylor over an 11-day period. Wright becomes the 30th condemned inmate to be put to death this year in the USA and the 1129th overall since the nation resumed executions on January 17, 1977.

The girl's father and grandfather were among the witnesses, but Nenno did not acknowledge them. Nicole Benton's grandfather walked up to the window separating him from Nenno and then turned around and walked to the back of the chamber.

Nenno, 47, confessed to the abduction and attack on Nicole 2 days after she disappeared from her dad's birthday party almost 14 years ago. Then he led officers to her remains in his home in Hockley, about 35 miles northwest of Houston.

"It's a parent's worst nightmare," Joan Huffman, the Harris County assistant district attorney who prosecuted Nenno at his 1996 trial, recalled. "Mr. Nenno was an evil person."

Nenno's appeals were exhausted and the Texas Board of Pardons and Paroles voted unanimously against commuting his sentence to life.

In a recent interview from death row, Nenno took responsibility for the girl's death and said he was prepared to die.

"My salvation is secure," he told The Associated Press. "I know where I'm going when this is all over."

Asked where that would be, he replied: "Heaven."

Nenno, born in Olean, N.Y., went to high school in nearby Smethport, Pa., then joined the Navy, where his attorneys said he was exposed to toxic chemicals during a four-year duty tour that left him brain damaged.

Nenno, however, said nothing could excuse his crime.

"I can't apologize enough," he said.

He lured the girl from his front yard into his house by telling her he needed to retrieve a guitar so he could join her father's band playing at the birthday celebration down the street. Once inside, he attacked her, strangled her to keep her quiet, then raped her at least twice after she was dead.

Police investigating her disappearance knocked on his door and when his nervousness attracted their attention, deputies had him accompany them to a command post.

Under questioning, Nenno said he thought the girl had been abducted, raped and murdered. Asked what kind of person he thought might do such a thing, he replied: "Someone like me."

"I was not cognizant I had committed the crime," he said from death row. "I had blacked out the memory."

He took a polygraph and underwent additional questioning.

"Things kind of fell apart," recalled Anthony Osso, Nenno's trial lawyer.

"I think she's still in the attic," Nenno told detectives.

In his confession, Nenno said he'd been having sexual fantasies involving young girls for most of his adult life.

"There was no evidence to suggest he ever acted on those fantasies," Osso said. "But for the most part, when you confess to elements of an offense, you make it much easier for the state. His statement led them to the body. He himself took them to it."

From death row, Nenno said he was addicted to pornography and had been drinking the day of the slaying.

"During the years that I have been imprisoned, I have often thought about the devastating grief and pain I caused Nicole Benton, her family, and her friends," he wrote in the clemency petition rejected by the parole board. "There is no excuse nor rationale which would be sufficient to justify this heinous act of violence perpetrated by me."

Osso said he believed Nenno's remorse was sincere.

"It's a sad case for all involved," he said. "It ripped apart Nicole Benton's family, and they were genuinely nice people. I don't think anybody could ever grasp the horror of that situation."

Huffman said she remembered questioning a medical examiner at Nenno's trial about the girl's fatal injuries.

"That had to be one of the hardest things I've ever done in my life," she said. "The family, they were right in back of me on the front row. I could hear them quietly crying. Some of the jurors were crying. It was heart-wrenching.

"She had been strangled and brutally raped and then she was raped again after she was dead. That's what the evidence showed. How could anyone sit in a courtroom and listen to testimony that that had happened to their 7 year-old child?"

Nenno becomes the 13th condemned Texas inmate to be put to death this year and 4th this month in the nation's most active death penalty state. Another execution is scheduled for Thursday. He becomes the 418th condemned inmate to be put to death in Texas since the state resumed capital punishment on Dec. 7, 1982, and the 179th overall since Rick Perry became Governor of Texas in 2001. On Thursday, Gregory Wright, 42, was set to follow Nenno to the death chamber. Wright was a homeless man convicted of taking part in the fatal stabbing of Donna Duncan Vick, a sympathetic Dallas County woman who had given him food, shelter and money. Court issues stay of execution for Troy Davis

The federal appeals court in Atlanta on Friday stayed the execution of Troy Anthony Davis, who was scheduled to be put to death by lethal injection Monday evening.

"Upon our thorough review of the record, we conclude that Davis has met the burden for a stay of execution," the court said in a ruling issued by Judges Joel Dubina, Rosemary Barkett and Stanley Marcus.

The ruling is only the latest in what has been a roller-coaster ride of appeals for Davis. It marks the 3rd time in 16 months he has won a stay shortly before his scheduled execution.

Last week, the U.S. Supreme Court said it would not hear Davis' most recent appeal.

Davis, 40, sits on death row for the Aug. 19, 1989, murder of 27-year-old Savannah police Officer Mark Allen MacPhail. Since Davis’ trial, seven of nine key prosecution witnesses have recanted their testimony.

Davis' claims of innocence have drawn opposition to his execution from leaders across the globe, including former President Jimmy Carter and Pope Benedict XVI. The European Union this week called for a halt to Davis’ execution.

Martina Correia, Davis' sister, said she and her mother, Virginia Davis, were packing for the trip to death-row in Jackson when they got the news.

"I've been praying," Correia said. "He deserves to be free. He at least doesn't deserve to die for something he didn't do."

Correia talked on the phone to Davis after the court issued its stay. "To all the people around the world working hard and fighting for him, he wants to say thank you and this fight has to continue," she said.

Neither MacPhail's mother or sister had heard the news when a reporter called. The officer's 75-year-old mother, Anneliese, declined to comment until she had more information.

MacPhail's sister, Kathy McQuary, cried.

Davis' lawyers expressed relief over the court's decision.

"This is the 1st step toward a court hearing to consider the new evidence - something we have been asking for for almost a decade now," attorney Jason Ewart said.

Russ Willard with the state Attorney General's Office said the office had told the Department of Corrections that the execution was off for Monday. In the meantime, he said, state attorneys are reviewing the court’s order and exploring the their options.

Earlier this week, Davis asked the 11th U.S. Circuit Court of Appeals for permission to pursue another round of litigation in federal court on claims he is innocent. The Antiterrorism and Effective Death Penalty Act of 1996 requires such a request to be made to an appeals court before another federal habeas corpus lawsuit can be filed.

On Friday, 11th Circuit said the stay of execution is conditional. Davis must make a showing he can meet the "stringent requirements" to pursue another round of appeals, the decision said.

The court directed Davis' lawyers to file a legal brief on their arguments within 15 days. The state Attorney General's Office has another 10 days to respond.

In July 2007, the state Board of Pardons and Paroles issued a stay less than 24 hours before Davis was to be put to death. Last month, the U.S. Supreme Court stopped Davis’ execution less than 2 hours before he was to be executed by lethal injection.

The court agreed to put off the lethal injection, scheduled for 6 p.m. Thursday, after lawyers raised new claims that the 42-year-old Woods is mentally retarded and legally ineligible for execution under U.S. Supreme Court standards.

Woods was convicted of killing his ex-girlfriend's 11-year-old daughter after abducting her and her brother from their home in Granbury, southwest of Fort Worth, in 1997.

Maurie Levin, an attorney and a professor at the Capital Punishment Center at the University of Texas School of Law School, filed the appeal Wednesday.

The issue of Mr. Woods mental competency had been raised previously in the case, but Ms. Levin said it had not been given adequate attention.

"No one had actually gone back and looked at Bobby's adaptive deficits," Ms. Levin said. "When you meet the guy, he is immediately and apparently impaired."

Former Hood County prosecutor Richard Hattox, the man responsible for Mr. Woods' conviction, said Mr. Woods' retardation claims had been explored and dismissed.

"There was no history of mental retardation," Mr. Hattox said. "There were no special education classes ever afforded him. He graduated on time, wasn't held back in any grades. He was functional. He had a driver's license."

Mr. Woods' crime was remarkable for its violence and because its victims were so young.

Cody was 9 in April 1997 when he and his sister, were kidnapped from their trailer home by Mr. Woods, officials said. Mr. Woods was the ex-boyfriend of the children's mother, Schwana Patterson.

Cody was bashed against a tree, choked and left to die on the shore of Lake Granbury.

But Sarah suffered a worse fate. The youngster was raped and her throat slashed. In May 1998, a Llano County jury convicted Mr. Woods of capital murder and sentenced him to death for Sarah's murder.

In a recent interview with The Associated Press, Mr. Woods, 42, said the children were hurt accidentally.

"I took the kids out and we were horsing around," Mr. Woods said. "We went walking around graveyards, horsing around by a fence. Cody jumped on my back and hit a fence post.

"I guess I panicked."

Mr. Woods said his cousin, who was with them at the time, left with Sarah and it is that cousin who killed her. But DNA and other forensic evidence pointed to Mr. Woods as the sole killer.

A medical examiner testified at Mr. Woods' trial that Sarah had genital warts – the same sexual malady that plagued Mr. Woods.

"That was astonishing," Mr. Hattox said.

In addition, Cody, who was beaten so badly that doctors had to pull skull fragments from his brain, testified that it was Mr. Woods who attacked him and his sister. He said he was awakened by his sister's screams as Mr. Woods beat her in the bed the children shared.

Mr. Hattox said Mr. Woods was motivated by anger at the children's mother, who had kicked him out of her home days before the slaying.

In her own subsequent trial in Abilene, prosecutors contended – and a jury concurred – that Ms. Patterson heard her children crying as they were being kidnapped but did nothing to protect them.

She was sentenced to 23 years in prison for injury to a child by omission, but the sentence was later reduced to 8 years. Ms. Patterson was paroled in 2005. She could not be reached for comment.

Cody is now 20 and works as a plumber's apprentice, Mr. Hattox said. He lives near Houston with his father and stepmother.

"He turned out to be a nice, good kid. I'm real proud of his progress," Mr. Hattox said. "The whole town kept up with him. We raised a bunch of money for him, and there's still money for his education and well-being."

To this day, the gruesome crime remains Hood County's only modern-day death penalty case, Mr. Hattox said.

"This is a small town and at that time we had never been confronted with anything of this nature," he said. "Thousands of people looked for these kids, searched for them. It had a huge impact on the schools and teachers, everybody."

Northeast Texas man executed for burglary-slaying

Condemned inmate Joseph Ries was executed Tuesday evening for the slaying of a 64-year-old Northeast Texas man during a burglary almost a decade ago.

Ries expressed love to friends who watched through a death chamber window and urged them to stay strong because "Jesus is coming back soon."

Looking toward another window, he told 2 daughters of his victim he was "really sorry for what I've done." Ries said he prayed that they would find peace through God.

"I hope he heals your heart. The truth is that you are going to feel empty after tonight. Standing with Christ in your heart, he can only give you peace. I pray you can find it. I really do."

As the lethal drugs began flowing, he started to sing a hymn. "Our God is an Awesome God," he sang. "Lord I lift your name on high." He then slipped into unconsciousness and was pronounced dead 7 minutes later at 6:17 p.m. CDT.

Ries, 29, was executed for breaking into the rural Hopkins County home of Robert Ratliff, fatally shooting him as the man slept, then driving off in the victim's car.

The U.S. Supreme Court rejected appeals by Ries' lawyer, James Terry Jr., who wanted the court to halt the punishment and examine the case, contending among his arguments that Ries' rights were violated because his earlier appeals were handled by an incompetent attorney. Terry also argued Ries' trial lawyer failed to adequately show jurors how Ries was raised by a drug-addicted and alcoholic mother whose parental rights twice were revoked, and how Ries was abused in some of the dozen foster homes where lived.

"We've got a system that's broken and at every level it's been broken for him," Terry said. He acknowledged the crime was horrible but contended Ries' life had been "shaped by the failures of those whose legal and moral duty was to help him.".

Ries had lived at Ratliff's home in Cumby, about 65 miles northeast of Dallas, but Ratliff kicked him out after he suspected Ries of stealing some items.

On Feb. 18, 1999, Ries stole Ratliff's farm pickup for a trip to San Antonio. He and a friend, Christopher Lee White, also 19 at the time, returned 3 days later to take Ratliff's Lincoln Continental because the truck got poor gas mileage.

Ratliff wasn't home, so they broke in and stole 2 rifles, drove the pickup into a pond until it sank, then waited behind a barn until he came home and went to sleep. Ratliff was shot, then they drove off in his Lincoln. Ratliff's body was found by a relative.

"Why Mr. Ries decided to stop and murder him, it's beyond me," said Martin Braddy, the Hopkins County district attorney who prosecuted Ries. "That's something only he can understand. He had the keys and he was leaving the house when they killed him. It just seemed so cold and callous and so useless."

Ries was arrested by police in Lawton, Okla. He was driving Ratliff's car, which by then had been reported stolen, and was wearing Ratliff's hat.

Prosecutors said Ries was the triggerman. A jury in Sulphur Springs deliberated seven minutes before convicting him.

"We don't have a lot of violent crime here, and so our jurors are not callous to it," Braddy said. "I imagine citizens in other jurisdictions see murders all the time, a part of everyday life, but not here. So it probably took some people aback."

Ries, who said drug use in high school worsened when he found easy access to drugs while attending Texas A&M-Commerce, said he was high when the shooting occurred.

"I'm not sure exactly what happened," he said recently in an interview outside death row.

He said he remembered stealing the pickup, driving to San Antonio and getting high and driving back.

"The next thing I know, I'm sitting in a car freaking out," he said. "I'd killed somebody."

He said he was high when he was arrested and when he made a videotaped confession to police.

The prospect of death was frightening "in a way," Ries said, but added that he'd accepted Christ into his life and was prepared for it.

"Life is just a bridge," he said.

Jurors who decided Ries should die also were told of his auto thefts, property damage, poor impulse control, disregard for rules and anger toward some relatives. White, his accomplice, was tried separately and received life in prison.

Ries becomes the 12th condemned inmate to be put to death this year in Texas and the 417th overall since the state resumed capital punishment on December 7, 1982. Ries becomes the 178th condemned inmate to be put to death in Texas since Rick Perry became governor in 2001.

On Thursday, another condemned inmate, Bobby Wayne Woods, 42, was scheduled to die for the 1997 murder of Sarah Patterson, the 11-year-old daughter of his ex-girlfriend. Her throat was slashed when she and her 9-year-old brother were abducted from their home in Granbury, about 25 miles southwest of Fort Worth.

Ries becomes the 28th condemned inmate to be put to death this year in the USA and the 1127th overall since the nation resumed executions on January 17, 1977.

Killer in triple slaying executed Thursday

A San Antonio street gangster who gunned down 3 people in the holdup of a Korean restaurant more than 6 years ago was executed Thursday evening.

Kevin Watts told friends he was thankful for their love and support. "For everybody incarcerated, y'all keep your heads up," he said. He told them to "stay strong and keep fighting."

"I'm out of here, man. I'm gone. Keep me in your hearts," he said.

As the lethal drugs began flowing, Watts said, "Can I say something? I'm dying but." At that point, he began snoring and stopped breathing a moment later. At 6:17 p.m. CDT, he was pronounced dead.

No friends or relatives of any of the victims attended the execution.

Watts, 27, confessed to the execution-style shootings where the newlywed wife of one of the victims also was abducted and raped. Earlier this year, returning to the Bexar County court where a jury convicted him of capital murder and decided he should die, Watts angrily confronted the judge scheduling his execution with an obscenity-laced tirade complaining about a racist justice system. The judge twice had to order him removed from the courtroom.

Watts' appeals had exhausted his appeals. Without the help of his lawyer, John Economidy, he filed a clemency request with the Texas Board of Pardons and Paroles that was rejected. Also without his lawyer's knowledge, he filed an appeal with the U.S. Supreme Court contending mental retardation should make him ineligible for execution, but Economidy said there was no evidence to support the claim and the court was returning the motion without even considering it.

Watts walked into the Sam Won Gardens restaurant the morning of March 1, 2002, after a night of drinking and drugs and demanded money. He ordered manager Hak Po Kim, 30, and cooks Yan Tzu Banks, 52, and Chae Sun Shook, 59, to kneel on the kitchen floor and face a wall. Then he shot each of them in the head.

He forced Kim's wife of 2 months to retrieve the wallet and keys from her dying husband, grabbed about $100 from a cash register, then drove off with her in Kim's SUV.

The truck was spotted at a nearby apartment complex parking lot and police arrested Watts about 3 hours after the shootings. He had tried to flee from officers with Kim's wife by ramming the truck into 2 patrol cars.

"He was caught with a victim by the police as he's trying to escape and he had the murder weapon literally tied around his neck," Bill Pennington, the Bexar County assistant district attorney who prosecuted Watts, said.

The abducted woman identified him during the guilt-innocence portion of his trial as the gunman at the family's restaurant. Then at the punishment phase of the trial, she testified how she was forced at gunpoint to perform sex acts.

"My intent was to put food on the table, get some money, go home and live happily ever after," Watts, in a death row interview last week, said of the robbery. "The situation gets out of control and one thing leads to another. When I woke up in the county jail, I said to myself: 'I ain't getting out.' "

Watts was from San Jose, Calif. He said when he was about 14 his mother tried to get him away from gangs there and moved him to San Antonio to live with an aunt.

"I came to Texas and I guess you could say I picked up where I left off with the gangs," he said.

Watts' record included misdemeanor convictions for evading arrest, criminal mischief, trespassing, marijuana possession and driving while intoxicated. He also had a weapons case against him as a 16-year-old.

He dropped out of San Antonio's Theodore Roosevelt High School in the 9th grade.

"School was boring," he said. "The teacher wasn't into it. I'm not into it. I got money on my mind. I want to get high, smoke some weed, make some money, be with the homies."

"So I became a full-time participant in the street life."

At the time of the shootings, he had an infant daughter. The night before the slayings, witnesses said he'd been drinking "thug passion," a champagne and cognac drink made famous by slain gangster rap singer Tupac Shakur, snorting cocaine and taking numerous pills.

Watts becomes the 11th condemned inmate to be put to death this year in Texas and the 416th overall since the state resumed capital punishment on December 7, 1982. Watts becomes the 177th inmate in the state to be executed since Rick Perry became governor in 2001.

4 more executions are scheduled in Texas before the end of the month, and 6 more are set for November. On Tuesday, Joseph Ries, 29, is the 1st of 2 prisoners set to die next week. He was convicted of breaking into a rural home in Hopkins County in northeast Texas and fatally shooting and taking the car of Robert Ratliff, 64, who was asleep.

Watts becomes the 27th condemned inmate to be put to death this year in the USA and the 1126th overall since the nation resumed executions on January 17, 1977.

Convicted child killer executed in Texas

A former East Texas truck repair shop owner was executed Tuesday evening for fatally shooting a 22-month-old boy in a spree that also killed the child's parents.

Alvin Kelly thanked God, expressed love to friends and relatives and denied committing the murder that led to his execution.

"I pray this gives you some peace," Kelly said from the death chamber gurney, looking at four relatives of the slain family. "I know you believe that you're going to have closure tonight. As I stand before God today, the true judge, I had nothing to do with the death of your family."

Kelly, 57, said he would ask God to not hold that against them. At the same time, he acknowledged killing another man for whom he was serving time when he was charged in the death of the 22-month-old, who died in 1984 in Gregg County, about 100 miles east of Dallas.

As the drugs were administered, he began singing a hymn praising God for coming into his life. "I thank you Lord Jesus for remembering me ... ," he sang as the drugs took effect and he slipped into unconsciousness.

12 minutes later, at 6:30 p.m. CST he was pronounced dead.

The U.S. Supreme Court last week refused to review his appeal. His lawyer returned to the high court with another appeal, asking for a reprieve while the justices examine a Tennessee case about whether poor death row inmates seeking clemency from state officials have a right to taxpayer-paid attorneys.

About 2 hours before his scheduled execution time, the justices turned down the appeal.

Kelly, in an interview last week outside death row, said he didn't want a reprieve and looked forward to "go home to God."

"That's what this is all about," he said. "I have friends and family who are sad. But I am happy. I'm not going to die. I have eternal life."

Kelly already was serving a 30-year prison term for murder when he was convicted of killing Devin Morgan, the 22-month-old son of Jerry and Brenda Morgan. Relatives discovered the bodies at their home in Spring Hill, a few miles northwest of Longview. Several items also had been taken, including a car, at least 5 guns and some television and stereo equipment.

The murders went unsolved for 6 years until a man in Michigan told authorities that his former wife, who also had been married to Kelly, had information about the case.

Prosecutors said his ex-wife never felt she could come forward because she feared Kelly, who turned to drug dealing and manufacturing after his truck repair business cratered because of his drug addiction.

By then, Kelly said he had found religion in the Gregg County Jail, where he was being held on a drug charge and then was implicated in the aggravated sexual assault of two fellow inmates. He turned down several plea deals to confess to the three slayings, saying that accepting the offers would force him to lie.

"If I was guilty, I would plead guilty," he said from death row. "But I can't stand before God on a lie."

He also denied the possibility he was so strung out on methamphetamines at the time of the shootings that he couldn't recall them.

"If I did it, I'd remember," he said. "If I did it, I'd admit to it."

And while acknowledging he once viewed himself as a gangster, he insisted prosecutors "wanted to make me out to be some John Dillinger."

Kelly Kubecka, who was 10 when her aunt, uncle and nephew were killed, represented her family witnessing Kelly's execution.

"When it comes to what he did to our family, I think he deserves it," she told the Longview News-Journal. "But it's been so long. He has sat behind bars for so long now."

At Kelly's trial, prosecutors presented evidence that showed Jerry and Brenda Morgan had been city marshal reserve officers, and Kelly's motive was that they were providing information about him to authorities.

He said with his previous murder conviction, plus convictions for burglary, weapons possession, controlled substance delivery and possession and aggravated sexual assault, "I didn't stand a chance."

"I still love Texas," he said. "I love bluebonnets. Texas didn't put me here. I put me here, by my lifestyle. I'm not pious. I'm not holy. I'm an old sinner."

Scheduled to die on Thursday is Kevin Watts, 27, convicted of the execution-style shootings of 3 people during a robbery at a San Antonio restaurant in 2002.

Kelly becomes the 10th condemned inmate to be put to death this year in Texas and the 415th overall since the state resumed capital punishment on Dec. 7, 1987. He's among a dozen condemned inmates scheduled to die over the next 6 weeks. Another lethal injection is set for Thursday. Kelly becomes the 176th condemned inmate to be put to death in Texas since Rick Perry became governor in 2001.

Kelly becomes the 26th condemned inmate to be put to death this year in the USA and the 1125th overall since the nation resumed executions on January 17, 1977.

WASHINGTON (CNN) -- An Ohio death row inmate was executed Tuesday after the Supreme Court rejected his last-minute plea that he was too overweight to be executed.

Richard Cooey, 41, and an accomplice were convicted of the 1986 murders of two college students.

Richard Cooey was executed as scheduled at 10 a.m. ET, the Ohio Department of Corrections told CNN.

Cooey had exhausted his legal appeals and Gov. Ted Strickland earlier denied the 41-year-old prisoner's clemency petition. Cooey murdered two college students in 1986.

The justices turned down a stay of execution, and the opportunity to address the larger constitutional claims over when a convicted person is medically unfit for capital punishment. The court was also asked to review Ohio's lethal injection procedures, and whether they were cruel and unusual punishment.

His lawyers have argued that the inmate-- at 5-foot-7 and 267 pounds -- is "morbidly obese," and has gained about 70 pounds since his incarceration at age 19. Prison food and confinement in his cell for 23 hours a day, limiting his opportunities for exercise, contributed to his weight problem, his legal team asserted in recent court filings.

Cooey also contends regular medication he takes for migraines will weaken the effectiveness of an anesthetic used in the a three-drug cocktail administered during execution. He says his veins are weakened because of his health issues, and the lethal drugs would amount to cruel and unusual punishment.

In 2003, a judge stopped Cooey's execution a day before he was to die on issues unrelated to his health claims.

A federal appeals court ruled Thursday that Cooey waited too long raise the medical issues, saying Cooey "knew of and could have filed suit over vein access prior to July 2005."

Cooey and a then-17-year-old accomplice were convicted of the brutal murders of Wendy Offredo and Dawn McCreery, students at the University of Akron. The men had been tossing concrete slabs onto Interstate 77, and one of them struck Offredo's car.

Pretending to "rescue" the women, Cooey and Clinton Dickens took the victims to a remote field, according to prosecutors. There the students were subjected to a three-and-a-half-hour period of rape, torture, stabbing, and fatal bludgeoning. Cooey carved an "X" into the stomachs of both women, prosecutors said.

Each man blamed the other for delivering the fatal blows, but both were convicted of murder. Dickens received a life sentence because of his age.

Cooey tried to escape from death row in 2005, when corrections officials said he constructed a ladder from magazines and bed sheets in an effort to scale the barrier around an outdoor recreation area.

At an August clemency hearing, Jon Offredo, brother of one of the victims, said, "Our family has never gotten an apology from Richard Cooey. We've gotten blatant lies and excuses. Is an apology too much to ask? How could he commit such an heinous act and not feel regret?"

But Cooey's lawyer, Dana Cole, said his client is sorry for his crimes.

The high court has not offered clear guidelines on what medical standards need to be met before an inmate is eligible for death. But in a case five years ago, the justices allowed inmates to at least make a claim that their specific physical or medical issues could be cause to block an execution.

The high court had sided with a convicted Alabama killer who claimed his veins were so damaged from years of drug abuse that executioners might have to cut deeply into his flesh to administer the deadly drugs.

Writing for the unanimous court, then-Justice Sandra Day O'Connor said the court was not going to "open the floodgates to all manner of method-of-execution challenges," as Alabama feared. "Our holding is extremely limited." That inmate is still on death row.

Richard Dieter of the Death Penalty Information Center, a data-resource group that opposes capital punishment, said the Supreme Court indicated that "how you're going to be executed is a civil rights matter, the same as if you were discriminated on the basis of race or gender or something like that."

A Washington state killer was given a 1994 reprieve after claiming he was too obese to hang. Mitchell Rupe at one time was more than 425 pounds, but weight-loss surgery in prison had reduced that to 275 pounds over the years. Subsequent legal efforts to execute him failed. He died in prison two years ago from a long illness.

Texas death row inmate set to die Tuesday for child's slaying

Alvin Kelly doesn't deny he committed a murder and deserves a prison cell.

But Kelly, 57, insisted he had no involvement in another murder spree – where 3 people, including a 22-month-old child, were gunned down 24 years ago in East Texas – that put him on death row.

The former Tyler truck repair shop owner is to be executed Tuesday evening in Huntsville.

He'd be the 10th Texas prisoner executed this year, the 1st of 2 set to die this week and the 1st of 12 scheduled for lethal injection in the next six weeks in the nation's busiest death penalty state.

"As I stand before God, I'm innocent of this case," Kelly said last week from a small visiting cage outside Texas death row. "I'm not responsible for this case. I'm not saying this to save my life. My life is for God. And I'm at peace with what's fixing to happen to me."

Kelly's lawyer, Scott Smith, was not optimistic but said he hoped the U.S. Supreme Court would stop the punishment while it considered another case from Tennessee about whether poor death row inmates seeking mercy from state officials have a right to lawyers paid by federal taxpayers.

Recent appeal attempts by other condemned inmates citing that case have not been successful.

"I doubt they're going to issue a stay on this one," Smith said. "But that's what we're working on."

"I didn't even know the victims," Kelly said. "I never heard of them. ... If I was guilty, I would plead guilty. But I can't stand before God on a lie."

He said with his previous murder confession, plus convictions for burglary, weapons possession, controlled substance delivery and possession and aggravated sexual assault, "I didn't stand a chance."

"I'm an ex-drug dealer scumbag," he said. "That's what they believe, that they're getting justice."

Rebecca Simpson, one of the prosecutors in the case, said the details remained vivid even nearly 2 decades after the trial.

"Who shoots a baby in the forehead twice? It's just horrible. I would never forget any aspect of that case.I have no doubt the evidence is overwhelming as to his guilt," she said.

Betty McGrede, whose daughter, son-in-law and grandson were killed, told the Longview News-Journal: "Nothing's ever going to bring my kids back, but (Kelly) lived longer than he really deserved to live,"

Kelly said the pressures of running his business prompted him to turn to drugs, which he said first were offered to him by a cross-country truck driver.

"I wound up getting addicted," he said. "The meth monster just took control."

At a federal evidentiary hearing, Kelly testified the night of the slayings he was out changing the engine in a truck. He also contended 3 witnesses, including his ex-wife, lied at his trial. A judge disagreed.

"I don't like what they did," Kelly said. "But I don't hold any animosity. I've diligently served the Lord here. It's time for me to go home."

He said he found the prospect of dying "exciting."

"No disrespect to this place, but this is not life," he said of death row. "This is not an execution. This is graduation, to go home to God. That's what this is all about."

2 days after Kelly's punishment, Kevin Watts, 27, was set to die for the execution-style shootings of 3 people during a robbery at a San Antonio restaurant in 2002.

Killer Richard Cooey readied for execution today

Richard Wade Cooey II, scheduled to die by lethal injection at 10 a.m. today, was served his special request meal at 4 p.m. Monday:

He ordered a T-bone steak with A-1 sauce, onion rings, hash browns, french fries, toast with butter, four eggs over easy, a pint of rocky road ice cream, bear claw pastries and Mountain Dew.

He had all evening to finish it. He also can ask for breakfast this morning.

Cooey, convicted of kidnapping, raping and murdering University of Akron students Dawn McCreery, 20, and Wendy Offredo, 21, in 1986, spent much of Monday afternoon speaking with his lawyer, Dana Cole, and Jim Cole, a Christian lay minister from Nashville, Tenn., who is serving as his spiritual adviser. Jim Cole is Dana Cole's brother.

Cooey spent time reading a Bible with Jim Cole, said Andrea Carson, spokeswoman for the Ohio Department of Rehabilitation and Correction. Cooey arrived at the Southern Ohio Correctional Facility in Lucasville, the site of Ohio's Death House, at 9:45 a.m. and was described by Carson as in "a very good mood."

He was given a medical and psychological evaluation by prison medical staff, who reported visually identifying two veins that appear suitable as injection sites for his execution procedure.

Cooey and his lawyer unsuccessfully argued in an appeal that his veins were inaccessible due in part to his obesity. He is 5 feet 7 and 270 pounds.

No family members visited the former Akron resident Monday. Carson said family members visited with him several days ago at the Ohio State Penitentiary in Youngstown before Cooey's transfer to Lucasville. Cooey did make a phone call to an unidentified family member during the day.

Cooey's lawyers Cole, Eric Allen and Greg Meyers will serve as his witnesses at Tuesday's planned execution. No family members are scheduled to attend.

Dawn McCreery's father, mother, brother and three cousins are scheduled to serve as victim's witnesses. Wendy Offredo's family will not attend.

Carson said some death penalty protesters are expected Tuesday, but said a busload of those in favor of Cooey's execution also could arrive. "There's a lot of emotion surrounding this case from the Akron community. A lot of emotion."

The Ohio Supreme Court denied Cooey's request for a stay of execution. Only the U.S. Supreme Court can save Cooey after his various appeals have been denied and his bid for clemency was rejected by Gov. Ted Strickland.

Supreme Court issues stay of execution for Freddie Owens

2-time killer Freddie Eugene Owens has received an indefinite stay of his scheduled Friday execution from the U.S. Supreme Court.

Chief Justice John Roberts Jr. signed the order Tuesday afternoon.

Roberts ordered the stay to allow the Greenville man's attorney time to raise constitutional issues to the high court dealing with his death sentence stemming from a 1997 robbery-murder on Laurens Road.

In his order, Roberts wrote that should Owens' petition for a writ of certiorari be denied by the justices, the stay would automatically terminate. That would clear the way for the state Supreme Court to set another execution date. A writ of certiorari requests the Supreme Court to review a decision by a lower court.

John Blume, a Cornell University law professor and death penalty opponent, filed the appeal. Blume is a former executive director of the South Carolina Death Penalty Project. He heads a similar program at Cornell.

The appeal that was filed Sept. 24 raises three issues from the penalty phase of Owens' trial that will be included in a writ of certiorari that will be filed with the state Supreme Court. They center on the trial judge’s admission of records dealing with Owens' behavior in prison.

Blume contended in the appeal that without the stay, "Mr. Owens will not have adequate time to properly prepare and file a writ ... in which to raise these constitutional claims."

He couldn't be reached for comment.

State Attorney General Henry McMaster opposed Owens request for a stay.

Office spokesman Gene McCaskill said Tuesday that the order gives Owens' attorney until Nov. 6 to file a petition for appeal to the U.S. Supreme Court, The Associated Press reported.

Owens, 30, had been sentenced to die by lethal injection at 6 p.m. Friday for the 1997 shooting death of Greenville convenience store clerk Irene Grainger Graves.

Hours after his conviction in 1999, he killed a fellow inmate, Christopher Bryan Lee, according to testimony and a statement by Owens that was read into the court record. Prosecutors have held that charge in abeyance pending the outcome of Owen' appeals.

Owens has been sentenced to death 3 times for the Graves' shooting, most recently in 2006. That sentence was unanimously upheld by the state Supreme Court on July 14. The court set aside 2 others because of judges’ errors.

The governor commuted his sentence to life without the possibility of parole as recommended by the state Pardon and Parole Board.

Young, 43, was sentenced to death for a deadly May 1996 robbery. The governor last week granted a 30-day stay of execution so he could hear arguments for and against his death sentence. Young had been scheduled to die by lethal injection July 22. A new execution date had been set for Aug. 21.

“This was a very difficult decision and one that I did not take lightly,” Henry said. “I am always reluctant to intervene in a capital case, and I am very respectful of a jury’s verdict, the prosecutors who tried the case and the victim’s family who suffered because of the crime.

“However, after reviewing all of the evidence and hearing from both prosecutors and defense attorneys, I decided the Pardon and Parole Board made a proper recommendation to provide clemency and commute the death sentence,” Henry said.

The Pardon and Parole Board recommended clemency for Young, who was convicted of killing Joseph Sutton, 56, at the Charles Steak House in northeast Oklahoma City.

The Pardon and Parole Board has recommended clemency four times in the past five years. Henry has granted a clemency request once since taking office in 2003.

Young was sentenced to death in 1996 after exchanging gunfire and killing a man during a botched robbery attempt of an illegal gambling operation.

In testimony presented at the board’s clemency hearing, Young’s attorneys argued the shooting was not premeditated and did not merit a capital sentence. They said their client turned down a plea agreement in his original trial that would have given him a life sentence.

Before making his decision, the governor reviewed Young’s case and personally interviewed both prosecutors and defense attorneys.

Police said Young and another man went to the steakhouse with the intention of robbing the restaurant. During the robbery, a man at the restaurant grabbed an attacker's gun and Sutton reached for his own gun and started shooting.

Young's case has been upheld on appeals, and the U.S. Supreme Court has refused a request to hear the case.

Witnesses were only able to identify Young by the crumpled-up shirt that lay on his hospital bed while he was receiving treatment. During the preliminary hearing, neither witness could identify Young in the courtroom. One witness later identified Young at trial. However, Young's DNA matched samples taken from the scene, according to testimony.

For the second time this year, a condemned Killeen killer received good news.

Denard Manns, 43, was scheduled to die Aug. 20, but a U.S. district judge ordered that the execution be delayed since Manns was without counsel.

Bell County District Attorney Henry Garza said Thursday that Manns' execution is now set for Nov. 13. Manns was sentenced to die by a Bell County jury for the Nov. 19, 1998, fatal shooting of an Army medic at her home in Killeen.

The order will only buy Manns a few months and will come six days shy of the 10th anniversary of the shooting that put him on death row.

Walter S. Smith Jr., chief judge in the United States District Court for the Western District, Waco Division, issued the order to delay the execution since Manns' attorney, Walter Reeves, was removed from the case.

Manns' execution date was set for Jan. 20, but it was put on hold. The Supreme Court refused to hear Manns' case earlier this year after his execution date was withdrawn pending the outcome of a Kentucky case the Supreme Court was hearing in Washington.

That case challenged the lethal injection procedure used for executions in Kentucky and 35 other states, including Texas, as unconstitutionally cruel.

Manns has already had appeals denied in state and national appellate courts.

Manns was found guilty in 2002 of killing Christine Robson, 26, who was attacked at her apartment in November 1998.

Manns was a recent parolee from New York, where he had been imprisoned a second time for armed robbery.

Evidence showed he was living with relatives two doors down from the victim's apartment. There was no sign of forced entry, leading authorities to believe she knew her attacker.

Manns' fingerprint was found on the .22-caliber pistol identified as the murder weapon. His DNA was detected on clothing on her body, and at the time of his arrest, he was in possession of her jacket and was carrying her jewelry.

Court files show he told a fellow inmate details of the crime that only the killer would have known because they had not been made public.

In earlier appeals turned down by the courts, Manns insisted the evidence was insufficient to identify him as the killer and argued unsuccessfully that his half-brother was responsible for the slaying.

Evidence showed Robson was shot at least four times in the head and also was robbed of credit cards, cash and her car.

Manns testified at his trial that he never was inside her apartment, never had sex with her, and got her jacket from a friend who had committed burglaries in the neighborhood and her jewelry from a drug addict.
